VEHICLE RENTAL AGREEMENT, TERMS OF USE & PROTECTION PLAN
TOPAZ CAR RENTAL
By making a booking, paying a deposit, or receiving a vehicle from Topaz Car Rental, the customer is deemed to have read, understood, and agreed to all terms and conditions below.
1. TOPAZ PROTECTION PLAN
This protection plan is NOT insurance.
It is an internal company protection fund, collected from customers’ daily protection plan fees, which is used to help cover certain repair costs according to the selected plan limit.
Simple explanation:
✔ Not an insurance company
✔ No individual insurance policy is issued
✔ No claim process to external insurance companies through Topaz
✔ Internal repair cost assistance system only

✔ Small scratches / minor dents
✔ Minor accidents
✔ Front windscreen hit by small stones during normal driving
✔ Suitable for long trips / family trips / Kundasang trips
5. NOT COVERED
❌ Driving under alcohol / drugs
❌ No valid driving license
❌ Flood / water entering engine
❌ Drift / racing
❌ Off-road use
❌ Misuse of vehicle
❌ Intentional windscreen damage
❌ Side / rear glass damage (unless specially approved)
❌ Tire / rim damage
❌ Lost key
❌ Towing charges
❌ Traffic fines / summons
6. IMPORTANT EXPLANATION FOR CREDIT CARD HOLDERS
Some premium credit cards offer benefits such as:
✔ Rental Car Insurance
✔ Collision Damage Waiver
✔ Travel Protection
✔ Overseas Rental Coverage
However, customers must understand that these benefits vary depending on the bank, card type, country, and each policy’s terms and conditions.
7. VEHICLE USAGE AREA (IMPORTANT)
Standard Area
Normal vehicle usage is allowed within:
Kota Kinabalu to Kundasang / Ranau
This is the main operation and support area of Topaz.
Outside Area / Outstation
Usage beyond the area above is not encouraged because:
✔ Roads in some parts of Sabah may be damaged / full of potholes
✔ Higher risk of tire puncture
✔ Higher risk of suspension damage
✔ Difficult to provide immediate assistance
✔ Rescue time may be very long
If problems happen in far areas, assistance may take:
6 to 12 hours or more, depending on location, weather, traffic, and road conditions.
8. FOR RENTALS WITH TOPAZ CAR RENTAL
Topaz Car Rental is a local small-scale company focused on affordable pricing and an internal protection system. Therefore:
✔ We do not issue international insurance policy documents
✔ We do not process credit card claims on behalf of customers
✔ We do not wait for claim payments from banks
✔ We are not involved in disputes between customers and banks
This means if damage occurs:
➡️ Customers must settle payment directly with Topaz first according to rental terms.
➡️ If customers wish to claim back from their bank / credit card later, that will be the customer’s own responsibility.

We recommend that you make your booking with international rental companies such as *Hertz* or *Avis*, because large companies like them usually provide:

✔ Complete documentation systems

# 12. CREDIT CARD HOLDERS
Some credit cards offer *Rental Car Insurance* benefits.
If you wish to use your credit card insurance claim, we recommend booking with international companies such as *Hertz* or *Avis*.
Topaz is a local small-scale company, and our system does not support external insurance claims through the company.

# 8. WHAT PREMIUM COVERS
If you choose Premium Protection, you enjoy Topaz’s best benefits:

If the following happens:
✔ Minor scratches
✔ Minor dents
✔ Minor accidents
Your maximum payment is only *RM300*.

## B. Front Windscreen Hit by Small Stones
If during normal driving, the front windscreen is hit by small stones from the road or passing lorries causing:
✔ Small crack
✔ Stone chip
✔ Minor windscreen damage
The claim may be considered under Premium Protection.

* Standard → Pay subject to review

If this add-on is not taken, third party claims may become the renter’s responsibility.

Sesetengah kad kredit premium menawarkan manfaat seperti:

Namun, pelanggan perlu faham bahawa manfaat ini berbeza mengikut bank, jenis kad, negara, dan syarat polisi masing-masing.
- KAWASAN PENGGUNAAN KENDERAAN (PENTING)
Kawasan Standard
Penggunaan biasa dibenarkan sekitar:
Kota Kinabalu hingga Kundasang / Ranau
Ini adalah kawasan utama operasi dan bantuan Topaz.
Luar Kawasan / Outstation
Penggunaan melebihi kawasan di atas tidak digalakkan, kerana:
✔ Jalan sesetengah kawasan Sabah berlubang / rosak
✔ Risiko tayar pecah lebih tinggi
✔ Risiko suspension rosak
✔ Sukar bantuan segera
✔ Masa rescue sangat panjang
Jika berlaku masalah di kawasan jauh, bantuan boleh mengambil masa:
6 jam hingga 12 jam atau lebih, bergantung lokasi, cuaca dan keadaan jalan.
Untuk Sewaan Dengan Topaz Car Rental
Topaz Car Rental ialah syarikat tempatan berskala kecil yang fokus kepada harga rendah dan sistem perlindungan dalaman. Oleh itu:
✔ Kami tidak mengeluarkan dokumen polisi insurans antarabangsa
✔ Kami tidak memproses claim kad kredit bagi pihak pelanggan
✔ Kami tidak menunggu bayaran claim daripada bank
✔ Kami tidak terlibat dengan dispute antara pelanggan dan bank
Ini bermaksud jika berlaku kerosakan:
➡️ Pelanggan perlu selesaikan bayaran terus dengan Topaz terlebih dahulu mengikut terma sewaan.
➡️ Jika pelanggan mahu claim semula kepada bank / kad kredit selepas itu, itu adalah urusan pelanggan sendiri.
Jika Anda Mahu Guna Benefit Kad Kredit Sepenuhnya
Kami mencadangkan anda membuat tempahan dengan syarikat antarabangsa seperti Hertz atau Avis, kerana syarikat besar seperti mereka biasanya mempunyai:
✔ Polisi standard antarabangsa
✔ Sistem dokumentasi lengkap
✔ Panel claim global
✔ Sokongan bank / insurance provider lebih mudah
- PEMEGANG CREDIT CARD
Sesetengah kad kredit menawarkan manfaat Rental Car Insurance.
Jika anda mahu menggunakan claim kad kredit, kami cadangkan booking dengan syarikat antarabangsa seperti Hertz atau Avis.
Topaz ialah syarikat tempatan kecil dan sistem kami tidak menyokong claim insurans luar melalui syarikat.

Bayaran maksimum anda hanya RM300.
- Cermin Hadapan Terkena Batu
Jika semasa pemanduan biasa cermin hadapan terkena batu kecil daripada jalan / lori lalu menyebabkan:
✔ Retak kecil
✔ Stone chip kecil
✔ Kerosakan ringan windshield depan
Maka tuntutan boleh dipertimbangkan di bawah Premium.

By making a booking, paying deposit, receiving or using a vehicle from Topaz Car Rental, the customer is deemed to have read, understood and agreed to all additional terms below.
Dengan membuat tempahan, membayar deposit, menerima atau menggunakan kenderaan daripada Topaz Car Rental, pelanggan dianggap telah membaca, memahami dan bersetuju dengan semua syarat tambahan di bawah.
1. SMOKING / VAPE / TOBACCO ODOR
MEROKOK / VAPE / BAU ROKOK
Smoking or vaping inside the vehicle is strictly prohibited.
No smoking / vape in vehicle. Cleaning & odor removal fee applies.
Merokok atau menggunakan vape di dalam kenderaan adalah dilarang sama sekali.
❌ Dilarang merokok / vape di dalam kereta.
✔ Caj pembersihan dan menghilangkan bau boleh dikenakan.
This includes cigarette smell, ash residue, vape odor, smoke stains or any unpleasant smell left inside the vehicle.
Ini termasuk bau rokok, abu rokok, bau vape, kesan asap atau bau tidak menyenangkan di dalam kereta.
2. PETS / ANIMALS
HAIWAN PELIHARAAN
No pets unless approved.
Haiwan peliharaan tidak dibenarkan kecuali mendapat kelulusan awal syarikat.
Pet fur, odor or dirt may affect the next customer.
Bulu haiwan, bau haiwan atau kekotoran boleh mengganggu pelanggan seterusnya.
Cleaning or damage charges may apply.
Caj pembersihan atau kerosakan boleh dikenakan.
3. DIRTY RETURN / SANITATION
PEMULANGAN KOTOR / SANITASI
Vehicle must be returned in reasonably clean condition.
Kenderaan mesti dipulangkan dalam keadaan bersih yang munasabah.
Excessive dirt, mud, vomit, sand, stains, rubbish or bad smell may result in cleaning charges.

❌ Pasir berlebihan
❌ Tumpahan makanan
❌ Sampah berlebihan
❌ Bau busuk
✔ Cleaning fee / caj pembersihan boleh dikenakan.
4. FUEL POLICY
POLISI MINYAK
Return same fuel level or refuel charge applies.
Kenderaan hendaklah dipulangkan dengan paras minyak yang sama seperti semasa diambil.
Example / Contoh:
✔ Full tank return full tank
✔ Half tank return half tank
If lower than original level, refuel charges and service charges may apply.
Jika kurang daripada paras asal, caj isi minyak dan caj servis boleh dikenakan.
5. LOST KEY / SMART KEY
KUNCI HILANG / SMART KEY
Lost key / damaged smart key = replacement charges.
Kunci hilang / smart key rosak = caj penggantian dikenakan.
This may include:
✔ Replacement key
✔ Programming smart key
✔ Locksmith charges
✔ Delivery / rescue charges
6. TIRE / RIM DAMAGE
KEROSAKAN TAYAR / RIM
Road conditions in Sabah may vary.
Keadaan jalan di Sabah berbeza-beza.
Tire puncture, sidewall tear, bent rim or rim scratches are not covered.

❌ Sidewall pecah
❌ Rim bengkok
❌ Rim calar teruk
Not covered and chargeable to renter.
Tidak dilindungi dan menjadi tanggungjawab penyewa.
7. UNDERBODY DAMAGE
KEROSAKAN BAWAH KERETA
Undercarriage damage not covered.
Kerosakan bahagian bawah kereta tidak dilindungi.
Including:
❌ Hit stone / langgar batu
❌ Hit road hump fast / langgar bonggol laju
❌ Divider impact / langgar divider
Repair charges may apply.
8. FLOOD / WATER DAMAGE
BANJIR / KEROSAKAN AIR
Driving through flood voids protection.
Memandu meredah banjir boleh membatalkan perlindungan.
Water entering engine, electronics, interior or towing due to flood is customer responsibility.
Jika air masuk enjin, sistem elektronik, interior atau towing akibat banjir, semua kos ditanggung pelanggan.
9. ILLEGAL PARKING / TOWING
PARKING SALAH / TOWING / CLAMP
If customer parks illegally:
Jika pelanggan parking salah:
❌ Illegal parking
❌ Double park
❌ Tow-away zone
❌ Clamp zone
Summons / clamp / towing fee customer responsibility.
✔ Saman
✔ Caj clamp
✔ Caj towing
adalah tanggungjawab pelanggan.
10. SPEED CAMERA / AES / LATE SUMMONS
AES / SPEED CAMERA / SAMAN LEWAT MASUK
Future summons after rental remain renter responsibility.
Sebarang saman diterima selepas tempoh sewaan tetapi berlaku semasa pelanggan menggunakan kereta masih menjadi tanggungjawab penyewa.
Including:
✔ AES
✔ Parking summons
✔ Traffic offences
✔ Local authority fines
11. EXTRA DRIVER
PEMANDU TAMBAHAN
Only registered drivers allowed.
Hanya pemandu yang didaftarkan dibenarkan memandu.
Unauthorized drivers may void protection.
Pemandu tidak berdaftar boleh menyebabkan perlindungan terbatal.
12. LATE RETURN / EXTENSION
LEWAT PULANG / LANJUTAN SEWAAN
Late return hourly/day charges apply.
Lewat pulang boleh dikenakan caj jam / harian.
If extension is required, customer must request early and subject to availability.
Jika mahu sambung sewaan, pelanggan perlu maklum awal dan tertakluk ketersediaan unit.
13. NO SHOW / LAST MINUTE CANCEL
TIDAK HADIR / BATAL SAAT AKHIR
Deposit forfeiture terms may apply.
Deposit boleh hangus mengikut polisi syarikat.
No show or last-minute cancellation may cause loss of booking slot.
14. ACCIDENT REPORT TIME LIMIT
TEMPOH LAPORAN KEMALANGAN
Must report within reasonable time after incident.
Kemalangan atau kerosakan wajib dilaporkan dalam tempoh munasabah selepas kejadian.
Recommended within 1 to 6 hours.
Disarankan dalam tempoh 1 hingga 6 jam.
Late reporting may affect protection review.
Laporan lambat boleh menjejaskan semakan perlindungan.
15. DASHCAM / GPS EVIDENCE
DASHCAM / GPS / BUKTI DATA
Vehicle may use GPS / dashcam for safety.
Sesetengah kenderaan mungkin menggunakan GPS / dashcam untuk tujuan keselamatan.
Data may be used for:
✔ Vehicle location
✔ Security monitoring
✔ Accident investigation
16. NATURAL DISASTER / FORCE MAJEURE
BENCANA ALAM / FORCE MAJEURE
Flight cancellation, flood, earthquake, landslide or road closure are outside company control.
Pembatalan penerbangan, banjir, gempa bumi, tanah runtuh atau penutupan jalan adalah di luar kawalan syarikat.
Booking changes are subject to current situation.
Sebarang perubahan tempahan tertakluk keadaan semasa.
17. JURISDICTION / LEGAL
UNDANG-UNDANG / LEGAL
Disputes governed under Malaysia / Sabah law.
Sebarang pertikaian tertakluk kepada undang-undang Malaysia / Sabah.

Sabah roads may contain potholes, steep roads, sharp bends, fog areas, landslide risk or uneven surfaces.

Drive carefully at all times.

KUNDASANG BRAKE / ENGINE WARNING
AMARAN KUNDASANG BRAKE / ENJIN
Use low gear downhill.
Gunakan gear rendah semasa turun bukit.
Do not press brakes continuously for long downhill roads.

In the event of an accident involving serious injury, permanent disability, fracture, hospitalization, theft, or death, Topaz Car Rental does not provide personal accident insurance, life insurance, medical insurance, theft insurance, or compensation coverage for the renter, passengers, third parties, or any related individuals.
This means Topaz Car Rental does not cover claims relating to:

❌ Broken hand / broken leg / fractures
❌ Permanent disability
❌ Hospital admission costs
❌ Medical treatment expenses
